Please specify <br />the seed mix to be used on the topsoil stockpiles; the seed mix should be reported as pounds of pure <br />live seed per acre. <br />4. The Applicant has stated that the ranch road will be bladed to an approximate width of twenty feet. <br />Please note that roads which are new or substantially improved must be included as part of the <br />permitted acreage per Rule 6.3.3(g). General maintenance of a road is acceptable; however, widening <br />a road would be considered a substantial improvement. Please respond. <br />5. The Applicant has stated that Lincoln County will construct a haul road into the pit. Please clarify if <br />this is in addition to the existing haul road. If this is a new haul road, then it must be depicted on the <br />Mining Plan Map. <br />6.3.4 Exhibit D — Reclamation Plan <br />6. The Applicant has stated that the NRCS recommended seed mixture will only be used on the portion <br />of the pit that will be returned to rangeland. Please identify the area which will be returned to <br />rangeland on the Reclamation Plan Map. In addition, please note that upon final release of the site, <br />the area which will be reclaimed to general agriculture will need to be planted with crops in order to <br />be released. If any portion of that area is fallow, the Division will not consider the post - mining land <br />use to have been achieved. <br />7. The Applicant stated that NRCS recommendation for seeding, mulching and fertilizing will be <br />followed. The applicant did not attach the NRCS recommendation to the permit application. Please <br />submit a copy of the NRCS recommendations or confirm that the NRCS recommendation submitted <br />with the original application will be followed. <br />6.3.5 Exhibit E — Map <br />8. The Mining Plan Map and the Reclamation Plan Map did not include a map scale. Please submit <br />revised copies of both maps and include a map scale. The acceptable range of map scales shall not be <br />larger than 1 inch = 50 feet nor smaller than 1 inch = 660 feet. <br />9. As required by Rule 6.3.5(2)(b), please include the names of the owners of record of the surface of <br />the affected area and identify the owner of the substance to be mined on the Mining Plan Map. - <br />10. The Mining Plan Map depicts a small offset between the southwest permit boundary and Hackberry <br />Creek. However, the Reclamation Plan Map depicts the southwest permit boundary as being located <br />on the east bank of Hackberry Creek. Please clarify this discrepancy and revise the maps as <br />necessary. i <br />6.3.6 Exhibit F — List of Other Permits and Licenses Required <br />No comment. <br />6.3.7 Exhibit G — Source of Legal Right -to -Enter <br />11. The lease agreement which was submitted by the Operator is between Lincoln County and JAMACO, <br />L.P.
