Executive Order 13186 — Migratory Birds <br />The Forest Service has evaluated the exchange for its effects upon migratory birds, as detailed in <br />EO 13186 and is in compliance. <br />Endangered Species Act <br />A Biological Assessment was prepared and used to support the determination in the EA that the <br />land exchange will have "`no affect" to the Canada lynx, a threatened species. <br />Federal Cave Resources Protection Act of 1988 <br />No caves are known to exist on either the FP or NFP. <br />National Historic Preservation Act <br />Heritage resource inventories have been completed on the FP. A cultural resources inventory report <br />was reviewed and the findings were concurred on by the Colorado State Historical Preservation <br />Officer. <br />Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) <br />Field examinations of the FP and NFP have been completed. All parcels have been inventoried <br />and contain no evidence of hazardous substances or petroleum products. Homestake Mining <br />Company of California is the principal responsible party under CERCLA for any liabilities <br />associated with past mining operations on the FP and will be acquiring the federal lands in this land <br />exchange. In the Agreement to Initiate document, signed January 24, 2013, Homestake Mining <br />Company of California has agreed to hold harmless, defend, and indemnify the United States <br />against any suit, claim, demand or action, liability, judgment or cost for environmental remediation. <br />An indemnification clause will be conveyed with the property via warranty deed. <br />Environmental Justice - Executive Order 12898 <br />There would be no adverse environmental effects of the proposed action on minority and low - <br />income communities. <br />IMPLEMENTATION DATE <br />Implementation of this project will not occur for a minimum of 50 days (45 day appeal period and 5 <br />day stay if no appeal is, received) following publication of the legal notice of this decision in the <br />Grand Junction Daily Sentinel. If an appeal is filed, implementation will not occur for a minimum <br />of 15 days following disposition of the appeal.
