I conclude that this decision does not <br />establish a precedent for future actions. <br />Consideration_ of the action in relation to other actions with individually insignificant but <br />cumulatively significant impacts. The EA evaluates the land exchange in the context of past, <br />present, and potential future actions that could lead to cumulative impacts, and no significant <br />impacts were identified. <br />Consideration of the degree to which the action may adversely affect districts, sites, highways, <br />structures, or objects listed or eligible for listing in the National Register of Historic Places, or <br />cause loss or destruction of significant scientific, cultural, or historic resources. The EA <br />discloses that one site was identified and the Colorado State Historic Preservation Officer <br />concurs with the Forest Service recommendation that it is not eligible for listing on the <br />national register of historic places. I have concluded that the exchange will not cause a loss or <br />destruction of significant scientific, cultural, or historic resources. <br />Consideration of the degree to which the action may affect threatened or endangered species, <br />or critical habitat. As determined in the EA and biological assessment, the proposed federal <br />action would have no reasonably foreseeable, direct, indirect or cumulative effects (therefore <br />"no effect ") on any federally listed or proposed plant or animal species or designated critical <br />habitat, including Canada lynx'. Overall, the exchange would likely benefit the lynx because <br />of a net increase in the quality of habitat being acquired and its proximity to the Fossil Ridge <br />Wilderness Area. <br />Consideration of whether the action violates or threatens to violate federal state local laws or <br />requirements imposed for protection of the environment. The land exchange does not violate <br />nor threaten to violate any federal, state, or local laws, regulations, or requirements for the <br />protection of the environment. <br />FINDINGS REQUIRED BY OTHER LAWS AND REGULATIONS <br />Executive Orders (EO) 11988 and 11990 <br />The Forest Service has evaluated the proposed exchange in accordance with EO 11988 <br />"Floodplains" and EO 11990 "Wetlands" and is in compliance. Both the FP and NFP are located in <br />the upper reaches of their respective watersheds. Field investigations have determined that <br />floodplain features are only minimally present on the NFP and absent on the FP. The narrow <br />floodplain on the NFP represents no risk to human health or property. The non - federal floodplain <br />does provide some ecological value as it supports a narrow riparian/wetland corridor. The exchange <br />will be consistent with EO 11988. <br />EO 11990 requires federal agencies to avoid impacts associated with the destruction or <br />modification of wetlands and to avoid direct or indirect support of new construction in wetlands. <br />The FP contains 0.99 acres of wetlands. The NFP contains 3.02 acres of wetlands. This exchange <br />will result in a net increase of about 2.03 acres of wetlands to federal management.
