River protection committees should anticipate questions from land.
O\\,:l1ers, citizens and officials. The Q/A below, though geared to the
federal act. can be adapted for state, local or privat~ programs.
Q. Won't the federal government wke oueraU the fand within miles
of the river?
^. No! The National Wild and Scenic Rivers Act limits the bound-
aries of a river corridor to no more than an ;;;.";::::.;:::~! :!20 ",,..ro..
per mite of river, which works out to about one-quarter mile
back from each bonk. Often, boundaries are narrower than this
upper limit. ...
Q. Doesn't the federot government halJe the power oj condemna-
tion under the wild and scenic rive~ oct? Won't they come in
Clnd buy off the land they can -011320 acres per mile?
A. Th~ wild and scenic rivers act does give federal agencies the
power of eminent domain, but they are reluctant to use it for a
number of reasons. First, the law limits full purchase to just 100
acres per mile of river on the average. Second, th~ government
is trying to cut spending. Buying up al\ the land allowed under
the law can be quite p.xp~nsive. so agencies have turned to plans
thC:ll minimize outright purchase. They try to manage the vast
majority of acreage through easements or zoning arrangements.
In many river corridors. most of the land stays in private hands,
with just a few small parcels along the river for public use sites
ui1der government control. Finally, the agencies responsible for
the wild and scenic rivers system do not want to alienate you,
the landown~r, and create a bad image for their agency. They
use eminent domain mainly to prevent pending development
thilt is incompatible with the scenic river.
Q. \Von't designation oj the river mean that my Jamily and I will
have to Teaue the land we have liued on and taken care oj Jar so
many years?
A. Not usually. If your land uses are in harmony with the general
character of the area-and they probably are-you and your
descendants will be allowed to live on your land and care for it
liS you have in the past The government will probably buy a
scenic edsement to protect your land from commercial en-
