<br />Q. Won't a scenic easement prevent me from farming my land?
<br />A. Absolutely not. The definition of scenic easement in the Get
<br />specifically states that it "shall not affect, Ulithout the owner's
<br />consent, any regular use exercised prior to the acquisition of the
<br />easement." So, you can continue to farm your property along
<br />the river. In a sense, an easement is a reward to the landowner
<br />for his good stewardship.

<br />Q. Won't a scenic easement prevent me from building additions to
<br />my home or farm?
<br />A. Probably not. The government will permit additions, if they do
<br />not significantly ch.ange the general appearance of the landscape
<br />as seen from the river. If the new structure is compatible with
<br />buildings already on the property, it certainly qualifies under the
<br />provisions of the ea~ment Such !'tructures as billboards visible
<br />from the river, garish commercial establishments or large resi-
<br />dential subdivisions right on the river will be outldwed. The only
<br />kind of prohibited agricultural structure is a large feedlot right
<br />next to the river.

<br />Q. Won't an easement allow free pubfic access to my property?
<br />A. No, not if it is a scenic easement. Scenic easements restrict only
<br />the type of development allowed on a piece of prop~rty. Th~y
<br />do not include rights for public use of the property. You can
<br />restrict trespass as you wish.

<br />Q. Won't an easement prevent me from selling my land orgil1ing it
<br />to my children?
<br />A. Absolutely not You retain title to the land and can sell or give it
<br />away as you wish. Moreover, the easement's restrictions on land
<br />use transfer with the title, 50 you \VOn't have to worry about
<br />someone destroying the land that you love at some future time.

<br />Q. Won't a scenic easement lower my property values? ..
<br />A. It might. It will definitely eliminate its potential for intensivp. de-
<br />velopment If you're a farmer, this is to your advantage, as ~'our
<br />property will be assessed for its value as farmland, rather than
<br />for its development potential. Even if development spreads to
<br />neighboring valle~'s, your land will be protected from the spiral
<br />of rising land values and taxes that has forced so many farmers
<br />off their land.
