<br /> <br />I , <br />l,.~...' <br />I ' <br /> <br />I <br />I <br />l <br />I <br />: <br />, <br />I <br />I <br />I <br />I <br />l <br />. <br />I <br />, <br />I <br />1 <br />l <br /> <br />@, <br />\'?it" <br /> <br />.(,f) <br /><..::p <br /> <br />" <br /> <br />EXHIBIT A <br /> <br />SCOPE OF WORK <br />FOR <br />ECONOMIC STUDIES ON THE .SOUTHERN UTE AND <br />UTE MOUNTAIN UTE INDIAN RESERVATIONS <br /> <br />GENERAL <br /> <br />Western Research Corporation (WRC) will perform economics <br />studies on the Ute Mountain Ute and Southern Ute Indian Reserva- <br />tions, assist in pre-trial discovery, including participation in <br />depositions, formulation of requests for admissions and interrog- <br />atories, develop and prepare exhibits and provide expert testimo- <br />ny for litigation concerning the adjudication of Indian reserved <br />water rights claims. The objective of these studies is to per- <br />form economic analyses and calculate costs for portions of irri- <br />gation systems in order to determine optional systems for the <br />study area. This work will be performed in close conjunction <br />with Boyle Engineering Corporation, the agricultural engineering <br />consultants for this set of studies. These studies will develop <br />data which will be used to support the State of Colorado's posi- <br />tion in the reserved water rights litigation concerning the two <br />Indian reservations. <br /> <br />The economics studies have been separated i'nto eight maj-or <br />work tasks. The first four tasks are (1) projection of crops, <br />yields, and potential markets; (2) on-farm budget analysis; (3) <br />capital cost pro~ections: and (4) integration of costs and re- <br />turns. The remalning four tasks are contingent upon the trial <br />arrangements for this litigation: the services described within <br />them will be provided as directed by the Department of ~aw and <br />are subject to separate authorization. These tasks are (5) as- <br />sistance in trial preparation; (6) expert testimony; (7) coordi- <br />nation with other experts; and (8) review studies of the United <br />States and Indian tribes. <br /> <br />The general approach to the economic analysis will .be to <br />adhere to economic principles consistent with previous court <br />precedent, where such precedent is available; and to adhere to <br />strict professional economic standards in those areas where court <br />precedent is either unavailable or inconsistent.
