Sparks, Direc tor <br />SUBJECT: Senate Bill 35 <br /> <br />Through the efforts of Senators Noble, Bishop and Anderson <br />an amendment is being proposed to Senate Bill 35 which would authorize <br />the Colorado Water Conservation Board to construct those projects <br />described in House Bill 1398. There is no chance for the passage of <br />H.B. 1398. The strategy developed by the three senators is to amend <br />Senate Bill 35. The proposed amendment is enclosed herewith. It will <br />be considered on the Senate Floor on Friday morning, April 22, 1977. <br />Since this amendment is being backed by the Republican leadership and <br />has some Democratic support, it has an excellent chance of passing. <br />After that, however, the bill will have to go the full route in the <br />House. Chances of passage there are reasonably good. <br /> <br />It should be noted that the amended S.B. 35 does not <br />immediately appropriate funds to this board for the construction of all <br />projects. However, the amendment represents a major break through in <br />continuous financing for the construction fund. The funds available <br />this year would be approximately $1,300,000 and should increase in <br />forthcoming years. The important aspect of the amendment is to autho- <br />rize construction of the various projects, which means that we will <br />then be in position to actively seek the required federal funds, as <br />applicable. We will also be at liberty to seek additional funds from <br />the general fund or from other sources in succeeding years. <br /> <br />Because the initial funds will be coming from the mineral <br />impact fund, the Senate has rearranged the project priorities to <br />conform with the federal act which authorizes the distribution of <br />mineral leasing funds. There may be some projects which cannot qualify <br />for the federal mineral leasing funds, but we will continue to have <br />other funds from project repayment and from possible general fund <br />appropriations.
