This matter comes before the Referee on the Application
for Water Rights of the Colorado Water Conservation Board
(CWCB) to grant its Application for an instream flow water
right in Tenmile Creek,

The Referee has reviewed the Application, has reviewed
all other pleadings in the file, has made such investigations
as are necessary to determine whether the statements in the
Application are true, and as a result is fully advised in the
premises, and does hereby enter the following Ruling:

101, et seq. (1990 Repl, Vol, 15).

Timely and adequate notice of this proceeding has
