This Application was filed on December 31, 1998, and was referred to the Water Referee
for Water Division No.2, in accordance with CRS. ~~ 37-92-101, et seq. All notices required
by law of the filing of this Application have been fulfilled and the Referee has jurisdiction ofthis
Application. A timely Statement of Opposition was filed on behalf of the East Twin Lakes
Ditches and Water Works. On May 13, 1999, the Division Engineer submitted a Summary of
Consultation and the Referee has given it due consideration.

The Referee having made such investigations as are necessary to determine whether the
statements in the Application are true and being fully advised with respect to the subject matter
