WHEREAS, a report entitled "Flood Insurance Study, Town of
Carbondale, Garfield County, Colorado," which includes floodplain
information and data for the Crystal River, dated February 5,
1986, has been prepared by Darner> and Moore under contract with
the Federal Emergency Management Agency; and '

WHEREAS, said report describes and outlines the floodplain
data and information for the storm and floodwater runoff channels
or basins of the study area; and

WHEREAS, the Town of Carbondale has requested the Colorado
Water Conservation Board to designate and approve the floodplain
areas as set forth in the aforesaid report; and

WHEREAS, Section 37-60-106 (1), Colorado Revised Statutes,
requires the Colorado Water COrlservation Board to assist in the
prevention of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised
Statutes, provide that such legiSlative bodies of local jurisdic-
tions may provide zoning regulations for land uses on o~ along
any storm or floodwater runoff channel or basin only after desig-
nation and approval by the Colorado Water Conservation Board; and

WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes,
directs the Colorado Water Conservation Board to designate and
approve storm or floodwater runoff channels or basins and to make
such designations available to legislative bodies of local
jurisdictions; and
