Stanton 1J'lJ'?' <br /> <br /> <br />DATE: January 25, 1998 <br /> <br />SUBJECT: Agenda Item 12a, January 28-29,1998 Board Meeting- <br />Authority to Expend Contributions of Money in Cooperative Projects <br /> <br />Introduction <br /> <br />The Department of Natural Resources Controller's Office has determined that, <br />while the Board has statutory authority to receive funds for cooperative projects with <br />local governments, the CWCB technically does not have the statutory authority to expend <br />such monies. This memo proposes an idea to amend the statutes so this will be possible. <br /> <br />Background <br /> <br />CWCB staff have negotiated cost sharing agreements with local governments in <br />the lower Arkansas River valley for the purpose of obtaining aerial mapping services <br />related to the Arkansas River Multi-Objective Channel Restoration Study (Upper Reach). <br /> <br />The Board's existing statutory authority for receiving contributions is in Section <br />37-60-121 (3), CRS, as follows: <br /> <br />"Contributions of money may be receivedfrom any county, municipalityJederal <br />agency, water conservation district, metropolitan water district, conservancy <br />district, water users' association, person, or corporation for use in making <br />investigations, contracting projects, or otherwise carrying out the purposes of <br />sections 37-60-119 to 37-60-122." <br />
