CRS; and WHEREAS. the Contractor's application for a grant from the Water Conservation Board Construction Fund has been received and approved by the Colorado Water Conservation Board; and WHEREAS. the Colorado Water Conservation Board desires ~o distribute said funds pursuant to law: and WHEREAS. the Contractor is an eligible public agency to receive grant assistance from the PIlot Program for demonstrating the benefits of water efficiency measures. NOW THEREFORE it is hereby agreed that: 1. Are;). Covered. The Contractor shall perform and accomplish all the necessary work and services provided under this Contract. as described in the attached Exhibit A. which is incorporated herein and made part of this Contract by reference. 2. Scope of Services. In consideration for the monies to be received from the State. the Contractor shall do. perform. and carry out. in a satisfactory and proper manner, as determined by the State. all work ~lements as indicated in the "Scope of S~rvices", set fonh in the attached Exhibit A. hereinafter referred to as me "Project" and incorporated herein. Work performed prior to the execution of this Contract shall not be considered part of this Project. 3. Responsible Administrator. The performance of the services required hereunder shall be under the direct supervision of Linda Luther. an employee or agent of Conttactor. who is hereby designated as the administrator-in-charge of this ProjecL If At any time the administrator-in-charge changes the Board mw:t be given written notice of the change and rntm approve the replacement before any funher monies are distributed. 4. Time of Perfoonance. This CODttact sbaII become effective upon proper execmioD of this Contract by lbe State CoDll'OlIer or his desisnee. The Project contemplated herein shall commence as soon as practicable after the execution of this Contract and shall be undertaken and performed in the sequence set fonh in the "Time of Performance" in the attached Exhibit A. Expenses incurred by the Contractor in associatiOD with said Project prior to execution of this Contract shan not be ~ligible expenditures. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract. and that completion of the Project shall occur no later than the termination date set forth in the Time of Performance in Exhibit A. 5. Compensation and Method of Pavrnent. The State agrees to pay to the Contractor. in consideration for the work and services to be performed. a (otal amount not to ~xceed 1WENTY FIVE HUNDRED AND NOIlOO Dollars ( :'52.500.00).
