<br /> This Contract, made this /!t day of � ;/c A 2002, by and between the State of
<br /> Colorado for the use and benefit of the Colorado Department of Natural Resources, hereinafter
<br /> referred to as the "State," and the National Fish & Wildlife Foundation, 1120 Connecticut Ave,
<br /> NW, STE 900, Washington, DC 20036, with an office located at the Rocky Mountain Arsenal,
<br /> 72nd and Quebec, Building 111, Box 19, Commerce City, Colorado 80022, hereinafter referred to
<br /> as the"Foundation" or the "Contractor."
<br /> WHEREAS, authority exists in the Law and Funds have been requested for appropriation for
<br /> payment in accordance with this Contract of a total of$1,359,200 from Fund No. 12H, AGY
<br /> PAA, APPR. SJ1, GBL SJ1, HJR# 01-1022, Contract Encumbrance No. C- 100-3 ({3 ; and
<br /> 'WHEREAS, four native species of fish that inhabit the Colorado River have been federally listed
<br /> as endangered: the Colorado Pikeminnow, humpback chub, bonytail, and razorback sucker, and
<br /> WHEREAS, the "Recovery Implementation Program for Endangered Fish Species in the Upper
<br /> Colorado River Basin" (UCRIP) was initiated by Cooperative Agreement on January 21, 1988
<br /> between the Secretary of Interior, the Governors of Colorado, Utah, and Wyoming, and the
<br /> Administrator of the Western Area Power Administration(Attachment A), and
<br /> 'WHEREAS, the "San Juan River Basin Recovery Implementation Program" (SJRIP) was initiated
<br /> by Cooperative Agreement on November 1, 1992 between the Department of Interior, State of
<br /> Colorado, State of New Mexico, State of Utah, the Navajo Nation, the Southern Ute Tribe, the Ute
<br /> Mountain Ute Tribe, and the Jicarilla Apache Tribe (Attachment B), and
<br /> WHEREAS,the actions required to recover the endangered fish are outlined in the UCRIP—
<br /> Recovery Implementation Program Recovery Action Plan(RIPRAP) and the SJRIP-Long Range
<br /> Plan(LRP) and the annual work plans associated with each, and
<br /> WHEREAS,the State participates on the UCRIP Implementation Committee and the SJRIP
<br /> Coordination Committee which are responsible for assuring that the recovery actions in the
<br /> RIPRAP and LRP are implemented, and
<br /> WHEREAS,the U.S. Congress passed Public Law 106-392 on October 30, 2000 (Attachment C),
<br /> also known as the Long Term Funding Legislation (S.1544 and H.R. 2348), which authorized the
<br /> Bureau of Reclamation to provide cost sharing for the endangered fish recovery implementation
<br /> programs in the Upper Colorado and San Juan River Basins, and
