<br /> WHERE AS, the Long Term Funding Legislation required cost share from the participating states
<br /> and federal agencies, including the Western Area Power Administration, and
<br /> WHEREAS, the Colorado Legislature enacted House Bill 98-1006 creating the "Species
<br /> Conservation Trust Fund" (C.R.S. 24-33-111) (Attachment D), one of the purposes of which is to
<br /> fund State participation in recovery programs designed to meet obligations arising under the
<br /> federal Elidangered Species Act of 1973, and
<br /> WHEREAS, the Foundation was established pursuant to the National Fish and Wildlife
<br /> Foundati m Establishment Act, 16 U.S.C. Sec. 3701, to aid and benefit fish and wildlife resources
<br /> and is in a position to receive and manage funds and to coordinate activities benefiting such
<br /> resource,, and
<br /> WHEREAS, the participants in the UCRIP and the SJRIP desire to have one entity that can receive
<br /> and manage funds from state and federal entities according to the cost share formula and to
<br /> coordinate the implementation of certain capital construction projects, and
<br /> WHEREAS, the purpose of this contract is to allow the State to provide cost share funds required
<br /> by Public Law 106-392 to the Foundation for use in implementing certain capital construction
<br /> projects :dentified by the UCRIP and the STRIP, and
<br /> WHEREAS, the respective Recovery Implementation Programs will identify, coordinate and
<br /> instruct he Foundation on which projects to fund and implement and will make the final
<br /> determinations on whether or not the projects have been satisfactorily implemented and completed,
<br /> and
<br /> WHEREAS, this contract relates to services to be provided by the Foundation for the State that aid
<br /> the State s participation in the UCRIP and the STRIP. The purpose of this contract is to facilitate
<br /> cooperat on between recovery program participants utilizing the Foundation as the means for
<br /> exchanging services, funds, and personnel; to assist the purposes, goals and objectives set forth by
<br /> the respective Recovery Implementation Programs. The work activities funded under terms of this
<br /> contract will be identified through the participation and mutual acceptance by the participants of
<br /> the RIPRAP and LRP. This contract will facilitate the restoration and protection of habitats for
<br /> federal nd re an eatened ish-ar�d dlifP species, an th$r-declizning species, in the—- -
<br /> Colorado River Basin and thereby aid in their recovery, and
<br /> WHEREAS, the cost for implementing both the UCRIP and the STRIP pursuant to Public Law
<br /> 106-392 is established at $100 million through federal FY 2007. The states' cost share is $17
<br /> million and Colorado's cost share contribution over this period is $9,146,000 ($8,065,000 for the
<br /> UCRIP and$1,081,000 for the STRIP). The following table shows the states' cost-share:
