� <br />� <br />MCA 2000-102 <br />AGENCY NAME: Water Conservation Board <br />AGENCY NUMBER: PDA <br />ROUTING NUMBER: <br />$75,000 <br />CONTRACT <br />THIS CONTRACT, made this 2otn day of November, 2000, by and between <br />the State of Colorado for the use and benefit of the Department of Natural Resources, <br />Colorado Water Conservation Board, hereinafter referred to as the CWCB and/or STa,TE, and <br />the Board of County Commissioners of Mesa County, State of Colorado, 750 Main Street, P.O. <br />Box 20000, Grand Junction, Colorado 81502-5010, hereinafter referred to as the CoNTRacTOR. <br />FACTUAL RECITALS <br />A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 424 Organization YYYY, Appropriation �0� GBL BO�Program <br />WTRC, Object Code 5120, Reporting Category 0050, Contract Encumbrance Number <br />C150050: <br />B. Required approval, clearance, and coordination have been accomplished from and with <br />appropriate agencies. <br />C. Section 37-60-121(1)(b)(IV), C.R.S., authorizes the STaTE to make grants from the CWCB <br />Construction Fund with specific authorization from the General Assembly. <br />D. In September 1999, the CoNTRa,cTOR and the Grand Junction Drainage District ("District") <br />held a public hearing on the need to address flooding issues relating to the Bosley Wash, <br />at which the participants proposed several mitigation measures for addressing such issues. <br />E. The CONTRACTOR in cooperation with the District, applied to the STATE for funding for a <br />cooperative flood control planning investigation of the Bosley Wash area, also known as <br />the Bosley Wash feasibility study, and a demonstration project in that area. For the <br />feasibility study, the CONTRACTOR WIII contribute $5,000 in cash and $5,000 of in-kind <br />services in the form of mapping, and the District will contribute $5,000 in cash and $10,000 <br />of in-kind services in the form of surveys. For the demonstration project the CONTRACTOR <br />will contribute $12,500 of in-kind services and the District will contribute $12,500 of in-kind <br />services. <br />F. At its November 1999 meeting, the CWCB approved a grant of matching funds to the <br />CoNTRa,cTOR from the CWCB Construction Fund in the amount of $50,000 to complete the <br />Bosley Wash Feasibility Study (" STUDY ") and in the amount of $25,000 to apply to the costs <br />of a demonstration project resulting from the Sru�Y (" PROJECT "). <br />G. Pursuant to H.B. 00-1419, Section 9, the General Assembly authorized the CWCB to <br />allocate $50,000 to the CorvTRacTOR to participate in the Bosley Wash feasibility study, and <br />$25,000 to the CoNrRACTOR to participate in a Bosley Wash drainage and flood control <br />Page 1 of 7 <br />
