SUBJECT: Hyannis Reservoir Company
Feasibility Study Loan
Contract #C153372, dated December 1, 1981

I spoke with Mark Haynes of the State Engineers Office of Dam Safety, who administers the listing
of all jurisdictional dams in the State, to determine that the Hyannis Peak Dam is not on the list of
existing structures.

I also spoke with Donna Taylor of Rocky Mountain Consultants, Inc. of Longmont, who completed
the original feasibility study that the CWCB financed, and determined that no further work was
completed on the project by the Hyannis Reservoir Company.

As of this date, the project to construct the Hyannis Peak dam by the Hyannis Reservoir Company
has not been completed, nor has any work beyond the completion of the project feasibility been
completed.

Therefore, the feasibility study contract #C153372 is closed and repayment will not be required
since the project has not been constructed during the initial 10 year period after the date of the
contract.
