A Special Executive Session of the Colorado Water Conservation Board (CWCB) was held, via
telephone conferencing, at 1313 Sherman Street, Room 721, Denver, Colorado 80203, at 10:10
a.m., Monday, October 29, 2007. The meeting was called to order by Chairman Travis Smith.
Seven voting members were present at the call to order so a quorum was present (at least six
required). Board members present on this date, via telephone conferencing system or in person,
were Travis Smith, Don Schwindt, Keith Catlin, John Redifer, Harold Miskel, Barbara Biggs, and
Harris Sherman. Also present, either in person or through the phone conferencing system was
Dan McAuliffe (CWCB Acting Director), Alex Davis (DNR Assistant Director of Water), Casey
Shpall (Deputy Attorney General), Susan Schneider (representing the Attorney Generals Office),
Dick Wolfe (representing the State Engineers Office), Randy Seaholm, and Ted Kowalski (both
representing the CWCB Water Supply Protection Section).
Executive Session Item -Proposed Durango RICD Settlement
Action: A motion was made by Harold Miskel and seconded by Keith Catlin to go into
Executive Session. The motion was approved unanimously (7-0).
Based upon the recommendation from Deputy Attorney General, Casey Shpall, the
discussion of the Durango RICD Settlement was not recorded pursuant to C.R.S.
section 24-6-4-2(2)(d.5)(I)(B), because this Executive Session constituted privileged
