attorney-client communications. <br />CWCB Attorney Date <br />The Executive Session on the Durango RICD Settlement was not recorded and was <br />confined to the topics authorized for discussion in Executive Session under C.R.S. <br />section 24-6-402(3)(a)(II). <br />CWCB Chair <br />Date <br />Action: A motion was made by Barbara Biggs and seconded by John Redifer to end the <br />Executive Session. The motion was approved unanimously (7-0). <br />Report from Executive Session -Per Deputy Attorney General, Casey Shpall, the Executive <br />Session was limited to the Durango RICD negotiations and settlement. <br />A motion was made by Don Schwindt and seconded by Barbara Biggs to approve staff <br />recommendation that the Board authorize CWCB staff to work with the Attorney General's <br />Office to take such actions as are necessary to effectuate a settlement of the pending <br />Durango RICD litigation. The motion was approved unanimously (7-0). <br />Footnote: It was the intent of the Board in effectuating the settlement of the Durango <br />RICD (Case # 06CW09) that such settlement occurs simultaneously with that in Case # <br />O6CW99 (La Plata County) and Case # 06CW127 (Southwestern Water Conservation <br />District and La Plata County), which cases provide the opportunity for senior water right <br />development in the future under the terms of the Colorado River Compacts.
