'.1 P <br />I' ,j t" <, <br /> <br />require the State Engineer to perform a llseless act whereby an appropriator <br /> <br />is enjoined from using water if such use did not injure any other appropriator. <br /> <br />(Here can be added any other standards which are though to be applicable <br /> <br />and binding on the Court in applying the system.) The decree when entered <br /> <br />shall be binding on the State Engineer in administering the waters of the <br /> <br />District and Division. Appeals can be provided as they are under present law. <br /> <br />(In lieu of a Court proceeding the statute could authorize exoneration <br /> <br />proceedings to be commenceri before the State Engineer or Division <br /> <br />Engineer or any other body deemed appropriate.) <br /> <br />/2/ Proceedings might be initiated by any g,'ound <br /> <br />water user either individually or on behalf of a class by filing a petition with <br /> <br />the Court naming as the defendant the State Engineer the object of which would <br /> <br />be to prevent new wells from being drilled or to curtail the amount of water <br /> <br />currently being pumped or to enjoin pumping under exi6ling wells. Such <br /> <br />petition must allege the basis for relief sought such as the petitioner's source <br /> <br />of ground waters being jeopardized by threatening a greater lift than is <br /> <br />economically feasible or that polution is threatened or any other standard <br /> <br />that here might be desired to be inserted. (In order to prevent the system <br /> <br />from becoming rigid, it could be provided that standards can be amended, <br /> <br />created, or modified, from time to time hereafter by some official such as <br /> <br />the State Engineer or any other appropriate entity upon proper hearing; <br /> <br />whereupon, such standard, as adopted or amended, shall govern and apply <br /> <br />to all users in the area.) Provision might be made that the report of the <br /> <br />United States Geological Survey for such Division or District shall be <br /> <br />presumptively correct, subject however to rebuttal unrier the proper rules <br /> <br />of evidence. If in any such proceeding, a decree is entered that no new <br /> <br />well shall be drilled or that the ground water supply is in jeopardy, then <br />
