It seems a fair inference per contra that it is of <br /> <br />equal importance to the Government that as agents, no rights or <br /> <br />privileges should be acquired which they, as lessees, do not now <br /> <br />enjoy. <br /> <br />For these reasons I am prepared to recommend that the <br /> <br />Secretary approve a contract continuing the operation and main- <br /> <br />tenance of the power plant building in the Bureau of Reclamation. <br /> <br />(b) Under Article 18 there is controversy between the <br /> <br />proposed agents and the Bureau of Reclamation as to the limita- <br /> <br />tions to be imposed upon the agents in the matter of the use of <br /> <br />water available at the project for the generation of power, with <br /> <br />particular reference to the use of such water for the operation <br /> <br />of "spinning reserve" at generating efficiencies less than the <br /> <br />efficiency contemplated in the original studies upon which the <br /> <br />present contracts are based. <br /> <br />If the matter of spir.ning reserve is provided for in the <br /> <br />m~~er covered later in these findings, I ~~ prepared to recom- <br /> <br />mend that the Secretary approve the language as proposed by the <br /> <br />agents under paragraph 18(a). <br /> <br />(c) Article 26.--The difference between the language pro- <br /> <br />posed by the agents and that proposed by the Bureau of Reclamation <br /> <br />presents a difference in concept as to the finality to be accorded <br /> <br />findings of the Secretary under the terms of this agreement. <br /> <br />The language of the article has been carefully recast in an <br /> <br />endeavor to state clearly and specifically the types of <br /> <br />6 <br />
