<br />The Amity Mutual Irrigation Company <br /> <br />I' <br />, <br />, <br /> <br />1391 <br /> <br />He then commented on the budget for 1990. The canal can <br />work on a little less, but the Board wanted a small cushion for <br />negotiations on some of these very important regulations. <br />Ft. Lyon has filed an application for a decree to remove <br />5400 a.f. from Queens storage. Amity has filed an objection, <br />but he assured the Ft. Lyon Board that Amity wants a good <br />working relationship. <br />Carl Shinn then commented that the objection filed was <br />strictly to monitor the case. He then asked "Who can go in and <br />gel the decree changed"? The Ft. Lyon-Amity agreement is <br />very old and in his opinion only Amity can ask to c;,ange the <br />decree. <br />Amity and Ft. Lyon are in litigation with the City of <br />Trinidad over water to be stored in Trinidad Reservoir. Mr. <br />Shinn is working with Ft. Lyon attorney in this matter. <br />In regard to the Gillis lawsuit, settlement conference was <br />held February 9 and the trial date is April 29.3U, 1990. <br />Purgatoire Conservation District cases are pending and <br />pretrial conference was delayed on changing the 1965 decree. <br />Purgatoire Water District is asking to store water if John Mar- <br />tin is spilling. This is in violation of 1950 conditional decree. <br />Paul Frank moved that we dispense with the reading of <br />the previous meeting, seconded by Paul Pierson. Motion pass- <br />ed. <br />Colin Thompson then said that the audit report was on <br />Page 8 of the Annual Report and that it was correct. He was <br />asked if this is the last payment on the loan from the Bureau of <br />Reclamation. He affirmed. Also, that the long term debt has <br />been reduced. <br />Clifford Verhoeff then moved that the first run of water be <br />put off until after April 16, 1990, as we have had such good <br />winter moisture; that the Board use their discretion and to start <br />afresh rather than try to finish the '/2 run of 1989. Wheeler <br />Oliphant, Jr. seconded. After some discussion, motion was <br />passed. <br /> <br />P.7 <br />
