. The option to participate in future downstream water marketing is
preserved _

. Full satisfaction of Tribes water rights under the 1986 Settlement
Agreement instead of something less as proposed by proponents of
"ALP lite" (The scaled back ALP lite would still not deliver a single
drop of water to Ute Indian lands), and

. Benefits could begin flowing to Utes from the date the fund is
established. The Tribes would not be left waiting and wondering if
ALP I & II will ever be built.

BENEFITS TO STATE AND FEDERAL TAXP AYERS

The outstanding obligations of the State of Colorado and the federal
government to the Ute people will be finally resolved for substantially
less money and at far less cost to the environment.

IMPACTS TO NON-INDIANS

There shouldn't be any! All acquisitions by The Ute Legacy fund would
be on a willing seller basis. Purchases by the fund would be on standard
commercial terms, which require compensation to other water right
holder~ who can demonstrate they are adversely effected.

Enlargement of existing storage facilities or conservation projects that
would increase the pool of water resources available in the region are
not inconsistent with this proposal. Through the fund, the Tribes could
participate in such projects that offered attractive benefits. However,
any such project should rise or fall on its own merits, and advance
politically and/or otherwise on its own horsepower.

5
