Governor Roy Romer <br />Office of the Governor <br />104 State Capitol <br />Denver, Colorado 80203 <br /> <br /> <br />Re: Appointments to the Arkansas River <br />Compact Administration <br /> <br />Dear Governor Romer: <br /> <br />Over the past eight years, my partner, Dennis Montgomery, <br />and I have been working on the litigation styled Kansas v. <br />Colorado, No. 105, Original (U.S. Supreme Court). The outcome of <br />the lawsuit is certainly very important to Colorado and her <br />interests in interstate water matters. During the pendency of <br />the litigation, the State of Colorado has been represented on the <br />Arkansas River Compact Administration by two individuals, Mr. <br />Carl Genova, representing the Arkansas River Valley above John <br />Martin Reservoir, and Mr. Jim Rogers representing Colorado's <br />interests below John Martin Reservoir. Both gentlemen have <br />served with distinction. <br /> <br />I anticipate that the Special Master will enter his <br />preliminary ruling in the Fall of this year. At that time, I <br />would expect the State of Kansas to disclose the next move it <br />intends to make in this on-going saga. One of the things of real <br />importance to Colorado's defense is that the water users continue <br />to react with sophistication to the issues before the Special <br />Master, as well as to the issues that corne before the Compact <br />Administration. I have some fear that Kansas will initiate <br />additional litigation or seek to amend the current litigation to <br />reflect any recent actions by Colorado with which it disagrees. <br />It is important for Colorado to make the best record possible <br />under the circumstances before the Compact Administration and to <br />do so with some care. As a result, I think it is very important <br />for you to reappoint both of the current Colorado Commissioners. <br />
