Cooperative
integration of the Barr system, coupled with an improvement in the water quality of Metro
effluent, will radically alter these habitual inefficiencies. Delayed repayment is a substantial
benefit to municipal users who would otherwise be required to make simultaneous
replacement of winter depletions to the Companies under Colorado law.

The water required to be returned to the Companies and their shareholders for irrigation is
only that amount that they would have ordinarily been supplied, given the diversions available
to the Companies' decrees during that specific year, but no more. There are several important
points regarding shareholder payback that should be considered:

I. Since the shareholders would be supplied on direct flows instead of by water
stored for months awaiting the irrigation season, the volume to be repaid would
be much less than the volume the Companies' were entitled to divert under their
decrees. If the shareholders were supplied directly ITom Beebe Draw alluvium
wells, the efficiencies would further increase.

2. The shareholders could most likely be repaid by effluent resulting from the first
use of its own water diverted and used upstream by a municipality. The volume
of water actually consumed by municipal use may well be much less than the
volume saved by improving on the existing Barr system inefficiencies, as
discussed above.

3. Depletions ITom municipal use of this water can be made up from non-tributary
return flows (which may accrue before or after the first use of the Companies'
water). transmountain return flows or other re-useable effluent.

7
