<br />November 30, 1992: <br /> <br />Public hearing held in Durango, Colorado. Other hearings are held <br />in Farmington, New Mexico on December 1, 1992, and Denver, <br />Colorado on December 2, 1992. About 125 stoJements were <br />received. <br /> <br />I <br /> <br />July 20, 1993: Commissioner of Reclamation signs a memorandum recommending <br />thai a Final Supplement to the 1980 FES be prepared which <br />addresses issues raised during the comment period; is based on <br />updating impacts of the project described in the 1979 DPR (including <br />refinements); and includes Clean Waier Act compliance <br />requirements. <br /> <br />September 1993: Reclamation sets a schedule date of June 1995 for filing the Final <br />Supplement with EPA and August 1995 for a Record of Decision. <br /> <br />November- December 1993: Using Indian Self Determination Act contracting procedures, <br />cooperative agreements are put in place with both the Southern Ute <br />Indian Tribe and the Ute Mountain Ute Tribe to conduct certain <br />studies and analyses, thereby assisting in completion of the Final <br />Supplement. <br /> <br />February 16, 1994: Consent decree is filed regarding the Four Comers Action Coalition, <br />et. al. lawsuit. Reclamation agreed to not perform cultural resources <br />related ground disturbing activities prior to completion of the Final <br />Supplement. As such, the previous preliminary injunction is <br />vacated. <br /> <br />April 19, 1994: In anticipation of u.s. F&WL Service designation of critical habitat <br />in the Colorado lliver Basin for four endangered fishes, Reclamation <br />requests initiation of ESA consultation regarding the ALP project <br />and critical habitat. The Service designaied critical habitat on April <br />20, 1994. <br /> <br />July 1994: U.S. Department of Interior Inspector General releases audit report <br />No. 94-1-884, "Development Status of the Dolores and the Animas- <br />La Plata Projects, Bureau of Reclamation." Regarding ALP, the <br />01G recommends thai economic and financitd feasibUity of the <br />project be reevaluaied and thai Congress be informed of the <br />reevaluation results. Reclamation had previously begun such an <br />economic analysis. <br /> <br />February 1995: Project sponsors agree on the concept of dividing Phase I of the <br />project into two Stages, A and B. In accordance with the project <br />depletion limitation of 57,100 acre-feet specified in the reasonable <br />and prudent alternative (RPA) of the 1991 FWS Biological Opinion, <br />Stage A facUity construction is defined generally as foUows: the <br />Durango Pumping Plant, llidges Basin Dam and Reservoir, Ridges <br />Basin Inlet Conduit, Shenandoah M&1 Pipeline, La Plata M&1 <br />(rural) Pipeline, and regional road and utility relocations. Also <br />included is mitigation for fish, wildlife, and wetlands. <br /> <br />9 <br />
