<br />f I <br /> <br />-29- <br /> <br />. <br /> <br />We observed one example of careless record-keeping which <br /> <br /> <br />would make it difficult to know exactly how much water was being <br /> <br /> <br />leased by the Riverside District. Attached to the District's <br /> <br /> <br />Warrant No. 1704 of August 18, 1966 was a "water order" for <br /> <br /> <br />"21-1/2 Jackson and RS rts. at $30 each for season of 1966". The <br /> <br /> <br />order was signed "Lower P&B Canal by Gill". It should be noted <br /> <br /> <br />that this water order does not indicate how many Jackson Lake <br /> <br /> <br />rights and how many Riverside rights were being transferred, but <br /> <br /> <br />only the total. It is difficult to understand how the District <br /> <br /> <br />would know how many of the Company "private rights" had been ac- <br /> <br /> <br />quired by this order, and how many were still outstanding and <br /> <br /> <br />might call for water. Cecil Osborne stated that this is of no con- <br /> <br /> <br />cern to the District since the Water Comissioner keeps records of <br /> <br /> <br />all of these matters and knows that the District is entitled to <br /> <br /> <br />"21-1/2 rights". The inconsistency with this interpretation is <br /> <br /> <br />that Riverside private rights were worth 12 acre-feet each in <br /> <br /> <br />1966, whereas Jackson Lake private rights were worth 16 acre-feet. <br /> <br /> <br />We understood from Cecil Osborne that John L. Samples, the Water <br /> <br /> <br />Commissioner, treats all private rights as being worth 15 acre- <br /> <br /> <br />feet for the purpose of these transfers, regardless of the true <br /> <br /> <br />facts. <br /> <br /> <br />Osborne further stated that the correct facts concerning the <br /> <br /> <br />above-described "water order" would probably show on the books of <br /> <br /> <br />the Lower Platte and Beaver Canal Company. He stated that the <br /> <br /> <br />order does not necessarily mean that the water rights leased were <br /> <br /> <br />owned by the Lower Platte and Beaver Canal Company.
