Subject: Ultimate Respo~sibility for Defrayment
of the Cost of Ruedi Reservoir and the
.Retroactive Application of the.Water Supply
Act of 1958 - Fryingpan-Arkansas Project,
Colorado

Pursuant to your request, a review has been made of the
three issues set forth on page 4 of your memorandum
concerning the above subject. You have asked for our
analysis of these issues.

The first issue is:

(1) Who bears the ultimate legal responsibility for
the cost of Ruedi Dam and Reservoir so far as the
costs allocated to the West Slope municipal and
industrial function?

The authorizing act for the Fryingpan-Ar~ansas Project (Act
of August 16,1962,78 :3tat. J1!.9) ?l:cvicies tr.at said project
nill be constructed, operate~, and ~aintained as set forth
in the September 1959 report entitled "R~edi Dam and
Reservoir, Colorado." In ~ciJLtion, the .;ct required that
the fry-Ark project "shall De operated under the direction
of the Secretary 1n accord~~ce with the cperating principles
adopted by the State of ColoradO on December 9, 1960. "
