That in order to comply with CRS. 37-92-304(6) the following findings and <br />conclusions are made: <br /> <br />(a) The historic use to which the water right were put is not applicable; <br /> <br />(b) The proposed future use of the water rights involved is set forth in paragraph <br />6 above. <br /> <br />(c) Other findings and conclusions relevantto the question of reconsideration of <br />injury to vested rights are none. <br /> <br />(d) The approval or award made herein should be and is hereby made subject to <br />reconsideration by the water judge on the question of injury to the vested rights of others <br />for five years after the date of the decree herein, which period is necessary or desirable to <br />preclude or remedy such injury. <br /> <br />IT IS, THEREFORE, ORDERED AS FOLLOWS: The Applicant be, and is <br />hereby awarded the plan of augmentation and storage right as set forth herein, consistent <br />with the tenns set forth herein and'the stipulations that are included herein as iffully set <br />forth in the body of this ruling. <br /> <br />IF IS FURTHER ORDERED that the approval of the plan contained in this Ruling <br />will be subject to reconsideration on the question ofinjury to the vested rights of others <br />for a period of five years after the date of the decree, upon the filing of a pleading by any <br />person claiming injury. <br /> <br />IT IS FURTHER ORDERED that the Applicant shall install and maintain such <br />water measurement devices as are deemed necessary by the Office of the State Engineer, <br />and the same shall be installed and operated in accordance with instructions from said <br />office. <br /> <br />IT IS FURTHER ORDERED that copies of the Ruling shall be mailed as provided <br />by statute. <br /> <br />Dated and filed with the Water Clerk this 18th day of April, 1995. <br /> <br />BY THE REFEREE: <br /> <br /> <br />3 <br /> <br />- <br /> <br /> <br /> <br /> <br />1;/ <br />
