<br />. <br /> <br />. <br /> <br />. <br /> <br />1"11:) <br />excess space would require amendment of the operating principles but the excess space could be <br />used on an interim basis through a contract with Reclamation for a temporary increase in the <br />permanent fishery pool, storage of water for municipal and industrial or irrigation purposes <br />provided the source of water was nontributary to the Arkansas River and the exchange of water <br /> <br />for storage of such water did not affect downstream users, all subject to the Corps' needs for the <br /> <br />space for flood control. <br /> <br /> <br />The Corps declared the channel capacity through the City of Trinidad had been re- <br /> <br /> <br />established to 15000 cfs and released the excess storage space for purposes other than flood <br /> <br /> <br />control on March 12, 1991. Following declaration of the re-established channel capacity through <br /> <br /> <br />the City of Trinidad, the Corps initiated a hydraulic analysis in late 1991 to re-evaluate the <br /> <br />existing channel capacity below the City of Trinidad. This study determined that a release of 3000 <br /> <br /> <br />cfs from Trinidad Dam would result in damages to the lands located downstream of the City of <br /> <br />Trinidad. The Corps is waiting for an opportunity to verifY the study with actuai releases from <br /> <br />Trinidad Dam. <br /> <br />The Corps released the excess storage space to Reclamation for contracting to potential <br /> <br />users in accordance with the Memorandum of Agreement dated May 23, 1990. The District <br /> <br /> <br />requested the excess storage space be allocated to the sediment capacity or joint use space as an <br /> <br /> <br />increase in the District storage right. Reclamation was not able to contract for use of the excess <br /> <br />storage space, consequently the Corps held a public meeting in Trinidad, Colorado on December <br /> <br />9, 1991 to discuss the disposition of the excess storage space. The District continued to request <br /> <br />that the excess storage space be allocated to the sediment capacity; however, Reclamation <br /> <br />received notice that this request had been rejected and was still available to Reclamation for <br /> <br />12 <br />
