<br />The IIAdvance Payback" arrangement previously mentionod hereinbofara will
<br />work as follows:

<br />During certain years there will be a capability ot bringing more rep14ce-
<br />meQt water oVlJr from tho Little Snake River drainage into thu Jlog Park Creek
<br />draJnage than' can be diverted on the other side of tho exchange system through
<br />the Douglas Creek Diversion Pipeline and into the City at Cheyenne. This will
<br />prqvide an opportunity to establish an "Advance Payback Account" in Seminoe
<br />Re.ervoir.

<br />In those years or periods of a year whe~ the availability of water from the
<br />Little Snake aide of the exchange system is greater than needed to balance gut
<br />thi diversions and/or storage from the Douglas Creek side of the system, the
<br />sutplus Little Snake diversions will be released downstream into the North
<br />P1~tte drainage and temporarily restored in Seminoe Reservoir where ie will be
<br />accounted for as lIAdvance PaybackU water. During spring runoff season (usually
<br />from early May through late June), the rate of diversion irom the Little Snake
<br />R1~er drainage tQ..llog Park Creek will exceed the allowable rate of release into
<br />Ho~ Park Creek ~c.f.s.) as provided in the U. S. .Forest Service Special Us.
<br />Pe~t. Maximum allowable release rates into Hog Park Creek will be maintained
<br />duting this period and the excess will be temporarily stored in the enlarged Pog
<br />Patk Raser~oir. After spring runoff when the flow of the North Platte River
<br />drops down to the point where some appropriators between the mouth .of DOt'glas
<br />Cr~ek and Seminoe Reservoir are unable to 1i11 their appropriations, the re-
<br />Pl~cement water added to the flow of Hog Park Creek will equal the direct flow
<br />diversions from the Douglas Creek side of the exchange. This condition will
<br />pr.~ai1 as long as there is insufficient water to meet the demands within the
<br />re~ch of the North PI~tte River between the mouth of Douglas Creek and Semfnoe
<br />Reservoir, usually until the end of the irrigation season, September 30. During
<br />tha nonirrigation season from October 1 - April 30. releases will be made from
<br />Hog Park Reservoir storage for the dual purposes .of enhancing the fishery down-
<br />stream and storing water in Seminoe Reservoir where it will be credited to the
<br />"Adyance Payback Account." This "Advance Payback Account" in Semlnoe Reservoir
<br />~~ be used as a means of balancing out the two sides of the exchange on an
<br />~ basis. - Releases' from Hog Park Reservoir for the purpose of storing water
<br />in Jeminoe Reservoir will be made only during the nonirrigation season (October
<br />1 through April 30), or at times when the flows in the Grand Encampment River
<br />and the North Platte River between the mouth of Hog Park Creek and Seminae
<br />Rea.rvoir are adequate to fill all valid appropriations divertin"therefrom, and
<br />the!1mported water-will not be diverted by intervening water users. Sucb
<br />rel~ases will be made in accordance with the requirements of the State Engineer
<br />and'will be carefully measured and accounted for.

<br />add1tions to the account as well as subtractions will be carefully accounted
<br />for'. At any time that Cheyenne I s increased stor.age in Rob Roy Reservo"ir plus
<br />the<direct flow diversions to the City of Cheyenne from Douglas Creek for a
<br />gi~n day exceed the ~eplacement releases of imported Little Snake water into
<br />H08:Park Creek, then the difference between these two figures will be deducted
<br />fro. the "Advance Payback Accountll in Seminoe Reservoir and credited to the
