~
00
o
C)

of Decision. The Council supports the rac:o...ndations set forth
in ths aecord of Deciaion ancl \lrge. that they be carried out.

Environmanbl Prot.act:ion AaAllt!V

The Council appreciates the r.enewed level of sUJlPort qi ven
to the Porua, the Council, and the salinity control program in 1989
by the Bnvironmental Protection Aqency (BPA). . Bowever, the Council
and the Forum do not believe that BPA qive. the Nation's most
extensive and succe.sflil nonpoint source water quality control
proqram the support and recoqnition deserves within the hiqher
level. of it. orqanization.

The Council remains concerned that there ha.been inadequate
internal coordination at the reqional offices and between reqional
and headquarters offices durinq the review of those portions of
environmental documents which' relate to salinity control.. Of
particular concern is the role of BPA in the BIS reviews. The EPA
should assure that adequate internal coordination on BIS reviews
be maintained so that unifo~ approaches are applied basinwide.
The Council wishes to be advised of any concerns BPA may have early
in the NBPA process to allow adequate and timely opportunities for
the Forum and the Cduncil to become involved in the resolution of
these'issues.

The Council remains concerned over the inconsistency in the
approval of the triennial reviews qiven by the three different EPA
reqions of the Basin state submittals. The Council believes that
EPA should provide a consistent and uniform. approval to the
Basinwide salinity control proqram.

The Council notes that land owner participation under the
Department of Aqriculture's onfarm, salinity control proqram with
reqard to the replacement of wildlUe values foreqone is voluntary.
The Council also observes that BPA has continuously expressed
concern that voluntary participation by land owners for habitat
replacement is and will be in the future inadequate. BPA actions
to date have done much to discouraqe voluntary participation.
There are siqnificant administrative delays to implementinq
voluntary proqrams because of the lack of an aqreed upon habitat
value procedure. The Council's recommendations concerninq this
issue are discussed under qeneral comments.

Of particular concern to the Council is BPA's opposition to
the issuance of 404 permit for theenbancement of pasture land by
replacement wi1:h "pen waterwetlllnd.'The Council understands that
the Corps of Enqineers believes the. provisions of the required 404
permit meets all necessary requirements and is prepared to issue

7
