<br />5 <br /> <br /> <br />00U781 <br /> <br />and development and use of water for all beneficial <br />purposes shall be in the state, which, in the exercise <br />of its police powers, shall take such measures as <br />shall effectuate full utilization and protection of the <br />water resources of the state of Iowa. " <br /> <br />The Oil and Gas Conservation Law enacted in 1963 (Iowa <br />Laws, 60 G.A., ch. 84) contained the following policy statement <br />pertaining to water resources: <br /> <br />"It is hereby further declared that the general welfare <br />of the people requires that the underground and surface <br />water of the state be protected from pollution and con- <br />served in the best interests of the people of the state. " <br /> <br />The following statement of policy is contained in the Iowa <br />Water Pollution Law (Iowa Code 1966, ch. 455B) enacted in 1965: <br /> <br />"455B.l Statement of policy. Whereas the pollution of <br />the waters of this state constitutes a menace to public <br />health and welfare, creates public nuisances, is harm- <br />ful to wildlife, fish and aquatic life, and impairs do- <br />mestic, agricultural, industrial, recreational and other <br />legitimate beneficial uses of water, and whereas the <br />problem of water pollution in this state is closely related <br />to the problem of water pollution in adjoining states, it <br />is hereby declared to be the public policy of this state <br />to conserve the waters of the state and to protect, main- <br />tain and improve the quality thereof for public water <br />supplies, for the propagation of wildlife, fish and <br />aquatic life, and for domestic, agricultural, industrial, <br />recreational and other legitimate (beneficial) uses; to <br />provide that no waste be discharged into any waters of <br />the state without first being given the degree of treat- <br />ment necessary to protect the legitimate (beneficial) <br />uses of such waters; to provide for the prevention, <br />abatement and control of new, increasing, potential, or <br />existing water pollution; and to co-operate with other <br />agencies of the state, agencies of other states and the <br />federal government in carrying out these objectives. " <br /> <br />The Iowa Soil Conservation Districts Law (Iowa Code <br />1966, ch. 467A) contains the following declaration of policy: <br />
