The approved source of water supply for the initial filling is limited to non-Arkansas <br /> <br />River Basin water delivered to Trinidad Reservoir either by direct imports from other river basins <br /> <br />or by excha.nge!l~rsuant to the laws of Colorado. Other conditions for the initial filling and <br /> <br />replacement of evaporation and seepage include: (I) all water rights on the Purgatoire River <br /> <br />downstream of Trinidad Reservoir must be satisfied during the period of any exchange; (2) the <br /> <br />specific source of imported or native water, as limited by the operating principles as amended <br /> <br />must be verified by the Colorado State Engineer; (3) for each acre foot of water stored in <br /> <br />Trinidad Reservoir, one acre foot of imported water or native water whose consumptive use has <br /> <br />been determined by final decree of Colorado Water Court must be delivered at the Las Animas <br /> <br />gauge on the Arkansas River; and (4) transit losses between the sources of supply and the Las <br /> <br />Animas gauge will be determined using the Livingston method or other suitable means to assure a <br /> <br />. one-for-one exchange at Trinidad Reservoir and Las Animas gauge. <br /> <br />A review of the amendment to the operating principles for allocation of the excess storage <br /> <br />space and filling said space reveals that the one-for-one exchange at the Las Animas gauge and <br /> <br />l(j.r <br /> <br />---'-~-'~--<.~~----_._---_._,---_.- <br /> <br />'~CIA _ <br />~rinidad Reservoir is a benefit to water users downstream ofthe_(;,~n.tl\J~n(;:: of the Purgatoire and ~j- <br /> <br />Arkansas Rivers. The amount of the benefit, as an increase in water supply, is in the amount of ~ ~ <br />It' .......~ <br /> <br />the transit loss difference in the four miles of the Arkansas River from the Las Animas gauge to <br /> <br />the mouth of the Purgatoire River and the transit loss that would occur in the 160 miles of the <br /> <br />Purgatoire River from Trinidad Dam to its mouth. <br /> <br />The one-for-one exchange should be the net amount at the confluence of the Arkansas and <br /> <br />Purgatoire Rivers as determined by Colorado State Engineer.
