'.,,~, <br />;1 ~'.;.:~,- <br /> <br />:1:::-_.::; <br />iF~[~..- . <br /> <br />5. <br /> <br /> <br />(a) The proposed use of water outside the state is <br /> <br />authorized by interstate compact or credited as a ,delivery <br /> <br /> <br />to another state, or that the proposed use does not impair <br /> <br />the ability of ColDrado to comply with decrees or interstate <br /> <br />compacts which appDrtion water between Colorado and other <br /> <br />states; <br /> <br />(b) The proposed use of water is not inconsistent with <br /> <br />the reasonable conservation of water resources of Colorado; <br /> <br />and <br /> <br />(c) The proposed use of water will not deprive <br /> <br />citizens of Colorado of the beneficial use of water <br /> <br />apportioned to Colorado by interstate compact Dr '!dicial <br /> <br />decree. <br /> <br />Thus, to effectl' ~e the delivery of water from Colorado <br /> <br />to the Authority as contemplated under the Agreement, a jUdicial <br /> <br />decree authorizing the export of this water from Colorado would <br /> <br />need to be obtained. <br /> <br />B. Colorado River Compact <br /> <br />The 1922 Colorado River compact between the seven <br /> <br />Colorado River Basin States of Arizona, California, colorado, <br /> <br />Nevada, New Mexico, Utah and Wyoming, which was consented to by <br /> <br />Congress in the Boulder Canyon Project Act of 1928 subject to <br /> <br />approval of the legislatures of California and five other <br /> <br />states,~1 apportioned the flow of the Colorado River System <br /> <br />between the Upper and Lower Basins. Of significance here are <br /> <br />four provisions: <br />
