Shinn, attorney for the <br />City of Lamar, Colorado, I advised the City of the terms under which <br />the Arkansas River Compact Aclrrdnistration would approve future use <br />of John Martin Reservoir to regulate delivery of Frying Pan-Arkansas <br />project water. <br /> <br />On 5/10/90 the City of Lamar notified me of its intent to initiate <br />the delivery of 2000 a.f. according to these terms. I responded on <br />5/21/90 by forwarding this notice to the Compact Administration. At <br />the time that I wrote this cover letter to the Administration, I <br />confused Lamar's allocation request to the Southeast Colorado Water <br />Conservancy District (SECWCD) for 20QO a.f. with the 2000 a.f. <br />regulation request trade to the AclrrdnistratiDn. By fixing on the <br />fact that Lamar had only been allocated 1700 a.f. in 1990 by the <br />SECWCD, I overlooked the fact that Lamar then had carry-over project <br />water and inadvertently led the Compact Administration to understand <br />that Lamar was linrited in its request for regulation at John Martin <br />to 1700 a.f. <br /> <br />No objection to the proposed operation as presented to the Compact <br />Administration was received within the prescribed three week notice <br />period. <br /> <br />By the time that my mistake was discovered, Lamar was then anxious <br />to begin the operation which it had requested and was unwilling to <br />await an additional notification/approval period. After conferring <br />with Lamar personnel, it was agreed that the City's objectives could <br />be achieved within the authority granted by the Compact <br />Administration by initiating the release of 1700 a.f. as proposed <br /> <br />JERIS A DANIELSON <br />State Engineer <br />
