<br />RE: Transfer of Twin Lakes Water to John Martin Reservoir Permanent Pool

<br />The Division of Wildlife (DOW) will be purchasing up to 17lD units of Twin
<br />Lakes water from Pueblo West Metropolitan District (District). The water is
<br />to be used to refill, in part, the permanent pool in John Martin Reservoir.
<br />The units of water, which the DOW is purchasing, are the units the District
<br />certifies as excess to their needs as described in the attached agE~~ment.~
<br />
<br />It was our understanding that this water was entirely transbasin in origin.
<br />However, it has been brought to our attention that there may be a small
<br />portion of native water included in the water available to each unit.
<br />Recognizing that this may be the case, we understand that this small portion
<br />of water may not be storable in John Martin's Permanent Rool and we therefore
<br />will defer to you the disposition of this water to the extent it is not
<br />useable for this purpose.

<br />The mechanics of how this transfer will take place, as we enV~S:LOn it, are as
<br />follows. As excess water becomes available, the District will periodically
<br />notify the D0\1 that it has certified, in increments of approximately 50 units,
<br />water to the DOW. We will then notify your office of this certification and
<br />coordinate with you the delivery of water from Twin Lakes to John ~1artin.
<br />Based on this coordination, we will contact the District and request release
<br />of the water per your instructions. I assume we can coordinate via telephone
<br />followed by written correspondence as you require.
