Response to your letter dated 12/8/89 - City of
Lamar's use of clohn Martin Reservoir to regulate
releases of Frying P~n Arkansas Water

I have been directed to write to you by the Arkansas River Compact
Administration, acting as its Operations Secretary. to advise YOU of
the Administration's action on your request.

It is the Administration's position that henceforth should the City
of LanJar desire to utilize ,John Nartin Reservoir in a manner similar
to that which occurred during 19.89, the following procedure is to be
followed to secure the Administration's approval.

Three weeks prior to the initiation of any operation which requires
the utilization of John Martin Reservoir as a regulating device, the
City shall provide written notice of its intent detailing the
specific terms of the proposed operation to the Operations
Secretary, These terms should include: the total volume, source,
and intended use of water to be regulated: the nomirial rate of
inflow to John Martin; (i.e., rate of release from Pueblo) the

delivery; the proposed date of initiation; and the approximate
duration of the operation. The Operations Secretary is to forward
said notice to the Administration, The Ci ty and. the Operations
/ Secretary shall consider the Administration's approval to have been
granted unless objection is received from either or both of the
States comprising the Administration, by the Operations Secretary
within the three week notice period.
