<br />001038 <br /> <br />. <br /> <br />. <br /> <br />BLUE RIVER ANALYSES <br /> <br />'\' <br /> <br />~ <br /> <br />General <br /> <br />f <br /> <br />On June 10, 1949, the United States of America filed in Federal District Court a <br />suit for declaratory judgement and, in the nature of quiet title, for establishment of <br />the dates of priority of appropriations for the Western Slope features of the Colorado- <br />Bi~:'Thompson project. This case, pending since the date of filing, is set for trial in <br />United States District Court in Denver, Colorado on October 3, 1955. <br />Following the filing of the above case, numerous matters have occurred which have <br />altered the situation which existed in 1949. During 1952, in a regular statuatory <br />adjudication proceeding in Summit County District Court, the City and County of Denver <br />was granted conditional decrees dating in 1946 for both direct flow and storage out of <br />the Blue River near Dillon, Colorado. Both the District and the United States had with- <br />dra~m their claims for appropriation from the Summit County proceeding. Subsequently, <br />this case was appealed to the Supreme Court of the State of Colorado and a decision <br />re~dered by the majority of the court in October, 1954. The decision of the Summit County <br />Court l1as upheld. Therefore, the priorities obtained by the City and County of Denver <br />nOll stand as of the dates assigned in the Summit County case. <br />~:~'merous attempts have been made since the time of filing of the original case in <br />Fe~er~l Court to reconcile differences between the various interests concerned with the <br />ut'.li~ation of the supplies of the Blue River.
