<br />provides that, if the bypass occurs during
<br />times when Mexican delivery orders are at
<br />the treaty minimum of 900 cubic feet per
<br />second, the flow of the river at Morelos diver-
<br />sion dam will be not less than 900 cubic feet
<br />per second.
<br />The seven-state Committee of Fourteen,
<br />with the Board's Chief Engineer as one of
<br />California's two members, had considered al-
<br />ternative courses to be pursued upon the ter-
<br />mination of Minute No. 218 and had agreed
<br />with the U. S. Commissioner, International
<br />Boundary and Water Commission, that a
<br />five-year extension of Minute No. 218 would
<br />be most desirable. However, in negotiations
<br />conducted by the International Boundary
<br />and Water Commission during the spring of
<br />1970, Mexican officials indicated that their
<br />government could not agree to a five-year
<br />continuation of Minute No. 218. The Mexi-
<br />can officials stated that, in order to keep Col-
<br />orado River water diverted for use at an ac-
<br />ceptable level of salinity, Mexico has been
<br />forced to bypass around Morelos Dam, and
<br />thereby lose an average of 50,000 acre-feet a
<br />year of the high salinity Wellton-Mohawk
<br />drainage water in addition to that quantity
<br />bypassed during minimum delivery periods.
<br />This 50,000 acre-feet per year of bypassed
<br />water reduces the quantity considered usable
<br />by Mexico below the treaty-guaranteed
<br />quantity of 1,500,000 acre-feet by the amount
<br />bypassed.
<br />Thereafter, the U. S. Commissioner, Inter-
<br />
<br />national Boundary and Water Commission,
<br />presented this problem and several alterna-
<br />tive United States positions thereon to the
<br />Committee of Fourteen by meetings and by
<br />correspondence. From these exchanges, posi-
<br />tions were developed that were subsequently
<br />used in continued discussions with Mexico
<br />by the U. S. Commissioner. By the end of
<br />1970, no agreement was reached with Mexico
<br />for a new five-year extension.
<br />In November 1970, Mexican authorities
<br />advised that there was not enough time re-
<br />maining to work out a new agreement prior
<br />to the new administration taking office in
<br />Mexico on December 1, 1970. They suggest-
<br />ed a one-year extension of the existing agree-
<br />ment embodied in Minute No. 218, and on
<br />November 16, 1970, the United States and
<br />Mexico agreed by an exchange of notes to
<br />extend Minute No. 218 until November 15,
<br />1971, with the understanding that the exten-
<br />sion may be superseded by a new agreement.
<br />This extension will permit the newly elected
<br />administration in Mexico to acquaint itself
<br />with the problems and to participate in the
<br />development of a new agreement.
<br />At a meeting of the Committee of Fourteen
<br />held on December 15, 1970, the U. S. Com-
<br />missioner and Bureau of Reclamation offi-
<br />cials reported the results of the fifth year of
<br />operation of the Wellton-Mohawk bypass
<br />cliannel ending November 15, 1970. Table 9
<br />summarizes some pertinent statistics from
<br />the Commissioner's report.
