All water deliveries to the 19,499 acres of the District irrigable area will be limited <br />during the irrigation season to the irrigation requirements at the farm headgate as determined by <br />the District. Allowance for canal and lateral losses on the individual ditch systems will also be <br />determined by the District. <br /> <br />3. Water deliveries from the District water supply may be diverted or stored for <br />M & I or pennanent fishery pool purposes with the following limitations: <br /> <br />(a) Only water attributable to the historic consumptive use of the District <br />water supply allocatel! for acreage removed from irrigation may be made available for M & I <br />storage or permanent fishery pool storage. <br /> <br />(b) Water attributable to historic return flows associated with the exercise of <br />the water rights used In the acreage removed from irrigation shall be released in such a manner as <br />to maintain the histor c return ,flow patterns to the Purgatoire River, as nec. :ssary to prevent a <br />material depletion thl reto. <br /> <br />( c) Removal of District irrigable land from irrigation to enable water to be <br />diverted or stored for M & I or permanent fishery pool purposes shall correspondingly reduce the <br />number of acres allo" ed to be irrigated from the District Water Supply. <br /> <br />(d) Water deliveries from the District water supply for storage in the <br />pennanent fishery po II shall be stored directly in the pennanent fishery pool capacity and any <br />water stored to maillllin historical return flow patterns pursuant to (b) above attributable to such <br />stored water shall be ,;tored in the irrigation capacity; provided such water stored shall not be <br />accounted for as storcd water in administration of the water storage limitations of the irrigation <br />capacity. <br /> <br />4. No water deliveries for irrigation of the 19,499 acres of the District irrigable area <br />will be made during the non-irrigation season. Water may be released during the non-irrigated <br />season for stockwater and for M & I use or to maintain historic return flow pattcrns for lands <br />removed from irrigation. <br />
