Facts are al\olays the basis <br /> <br /> <br />of legal problems and hence the facts must be studied. To what <br /> <br /> <br />degree the facts 'must be studied--I refer to the degree of fineness <br /> <br /> <br />of detail-_is a matter upon which there may be a variance of opinion. <br /> <br /> <br />To some of you who have given some little time and thought it is self-' <br /> <br /> <br />evident that the problem is simple, in that the \oIater supply exceeds <br /> <br /> <br />its area. If that be true and if this be the common consensus of <br /> <br /> <br />opinion the study of facts need not go to that degree of fineness <br /> <br /> <br />\oIhich \oIouldbe the case 'were the lands unlimited or the water supply <br /> <br /> <br />more limited. The extent to \oIhich this Commission -may :go in side- <br /> <br /> <br />recommendations as to the place- and position of various structures is <br />a matter that some of us feel should be developed later on as the <br />case proceeds. <br /> <br /> <br />The very great danger of the Commission entering into the <br /> <br /> <br />problems tha:t are purely ,.Hhin the province of Congress might provoke <br /> <br /> <br />an assertion of rights by Congress, which, in turn, might prove dis- <br /> <br /> <br />asterous to the main objective. of this conference, which is to settle <br /> <br /> <br />title to the ,river before structures are placed thereupon. A degree <br /> <br /> <br />of caution is necessary. 'We must proceed respecting such matters in <br /> <br /> <br />a way that will neither offend the states nor Qongreee because Con- <br /> <br /> <br />gress has ,certain exclusive privileges which it very jealously <br /> <br /> <br />reserves to itself. The United states created Congress for that very <br /> <br /> <br />purpose and Congress is made up of' representatives of the people bf <br />the United States and it is their'business to be jealous of their <br />jurisdiction.
