This would be <br />a problem on both ditches. Contractors would be allowed as much room as <br />possible without destroying any major improvements. In areas with <br />restricted rights-of-way, contractors would have to modify their usual <br />operation. <br /> <br />Riohts-of-wav <br /> <br />Price and Stubb Ditch Improvements.--Reclamation holds no rights to the <br />private irrigation systems. Improving canals within these systems would <br />require the donation of construction rights-af-way by individual entities, <br />groups, or organizations. The irrigation districts currently claim a 70 <br />foot of rights-af-way for their ditches. Since very little of the existing <br />rights-of-way is recorded, the historical usage of the rights-of-way has <br />defined the width to be approximately 45 feet. Approximately 70 feet of <br />rights-af-way would be required to construct the ditches. The districts <br />would record the historical 45 foot rights-of-way as well as obtain, <br />through donation, and record an additional 25 feet of rights-of-way. Table <br />2 summarizes present and projected rights-of-way needs. Following <br />construction, landowners would be permitted to use a portion of the <br />easement for raising crops and for the installation and maintenance of <br />fences. The 25 feet of additional rights-of-way equals an additional 59 <br />acres of land, apparently all on private land. It may be necessary to <br />decrease the desired 70-foot rights-of-way width in areas where it is not <br />feasible to obtain the additional width due to major existing improvements. <br />Damages to growing plants, trees, crops and permanent improvements, caused <br />during the initial construction of the ditches, would be reimbursed. <br /> <br />In general, the alignments of proposed improvements for the ditches would <br />be within the operating boundaries or rights-of-way as they presently <br />exist.
