Closs a, Class C and Section 25 contract ai- <br />lottees will be notified of their Quotas im- <br />mediately following the quota declarations <br />made by the Board. <br /> <br />Rules and Regulations <br /> <br />governing <br /> <br />Reallocation and Transfer of Class D <br /> <br />Allotments <br /> <br />Prior to setting forth the Rules and Regulations <br />of the Board of Directors, there are several perti- <br />nent facts regarding the individual. or Class D, allot- <br />ments which should be recognized by the allotteeB. <br />First, an allotment is made by vOluntary petition <br />of a land owner requesting a certain number ot acre- <br />feet ot water and. thereafter, an order of the Board <br />of Directors allotting a definite number of acre- <br />foot units of water to the lands described in the own- <br />ers petition. <br />Se<:ondly. by law, and contract. the allotment is <br />attached to the described land for assessment pur- <br />poses. It makes the land subject to an annual !lat <br />assessment tor the use ot the water and becomes <br />a tax lien against the land and collectible along <br />with other taxes. The allotment tollows the land <br />whenever the entire tract Is conveyed trom one party <br />to another. The allotment is not modified or changed <br />by such transaction. However, a purchaser should <br />Inform the District to permit the correction of allottee <br />records. <br /> <br />Thirdly, modification or change of an allotment <br />occurs when property is divided in ownership or when <br />it is requested that water be permanently moved to <br />other land than that to which it is already attached. <br />As provided by the Conservancy District Act, only <br />the District Board is given the power to reallocate or <br />transfer the water supply of tbe District. Such modi- <br />fications or changes must be made by action and <br />order of the Board. The Act also gives to the Board <br />the power to make and enforce all reasonable rules <br />and regulations. <br />Thererore, tbe Board of Directors has established <br />procedures by which allottees may make application <br />to the Board for modifications or changes of the orig- <br />inal allotment. In general, these required changes <br />are divided into two classes, (1) Reallocation and <br />(2) Transrer. <br /> <br />Water Deliveries <br /> <br />All water deliveries by the District will be gov- <br />erned by the requirements or the Colorado Water <br />Conservancy District Act. the repayment contract <br />between the District and the United States, and in <br />conformance with all allotment contracts between <br />the District and its water Users. The Rules and <br />Regulations which follow have resulted from trial <br />and testing over the past 10-year operating period. <br />They are designed to give the maximum possible <br />flexibility in service to the water users at a reason- <br />able operating cost to the District. Strict adherence <br />to the Rules and Regulations will be necessary ex- <br />cept in case of emergency. <br /> <br />(1) Individual, or Class D, allottees are respon- <br />sible for such arrangements as may be required <br />for the carriage of allotted water by the ditch <br />system wbich supplies their lands. Orders for <br />delivery of water, as allotted by Class D con- <br />tracts, must be made directly with the carrier <br />ditch companies and in accordance with such <br />companies' rules and regulations governing the <br />ordering and delivery of water. <br /> <br />(2) The annual quota declared available to each <br />contract allottee, if ordered tor delivery, will <br />be delivered from the works at the District <br />into the natural streams or s~cUied project <br />works. <br /> <br />REALLOCATION <br />Reallocation is the process provided for in the <br />Conservancy District Act, of dividing an original <br />allotment among specified parcels of land witbin the <br />boundaries of the tract ot land described in tbe <br />original Allotment Petition and Order. <br />This procedure permits the division of an allot- <br />ment and accompanying lien to fit the requirements <br />of supplemental irrigation on the parcels into which <br />an original tract has been divided in ownership sub. <br />sequent to the original allotment order. <br /> <br />(3) Deliveries of water will be made upon demand <br />between April 1st and November 1st of each <br />year, subject to the availability of delivery <br />capacity as determined by the District. The <br />District wil1 make every reasonable and dili- <br />gent effort to deliver ordered quantities in <br />flccordance with requestg. If. however, total <br />amounts requested for delivery in any period <br />exceed the capacities of the District's delivery <br />facilities, the Board will make such reasonable <br />adjustments as may be necessary. <br /> <br />(4, All portions of any annua.l quota which are <br />not ordered for delivery prIor to November <br />1st shall be cancelled and will remain in the <br />project system as a part or the water supply <br />to be declared available in the annual quota <br />of the next succeeding year. <br /> <br />(5) Ditcb company orders for starting, modifying <br />or shutting off a run of water must be made to <br />the concerned Water Commissioner. Such <br />orders may be made to the Water Commis- <br />sioners by telephone, but all orders must then <br />be immediately confirmed to the District In <br />writing on the Order Cards (Form CD.3) :Cur- <br />nished by the District. <br /> <br />(6) Requests (or commencement, modification or <br />shut down of water runs which would require <br />a change ot flow at flny project delivery point <br />between the hours of 10:00 P.M. of one calendar <br />day and <I: 00 A.M. of the next calendar day <br />will not be accepted unless emergency condi- <br />
