Existing permitting programs <br />'. c:.o <br />~1~ administered by State and Federal agencies ensure that nonpoint source <br />:.\JO:l <br />concerns are expressed and taken into account in major development plans. <br />., <br /> <br />,~" <br /> <br />;!~ <br />~}j <br />,...1 <br /> <br />,.'. As. outlined in the Colorado Nonpoint Source Management Program, federal <br />t~:~ <br /> <br />(3 consistancy reviews are a' part of the state strategy for controlling nonpoint <br /> <br />'"f..'J <br />~::~, <br />"j/$t <br /> <br />sources. A number of federal assistance programs and development projects are <br /> <br />~.:j <br />'-"~ <br />t;~' <br /> <br />eligible for Water Quality Control Division review through this process. In <br /> <br />Colorado, due to the federal ownership of many of the lands where high quality <br /> <br />.~~~ <br />t:~ <br /> <br />waters exist, this review offers great opportunities for prevention of new <br /> <br />nonpoint sources problems. Additionally, the State 401 certification process <br /> <br />for Corps of Engineers 404 dredge and fill permits also resides in the Water <br /> <br />Quality Control Division. This certification process allows Division review <br /> <br />of all 404 activities which require a permit. The Division through this <br />authority may add conditions to permits to ensure protection of high quality <br /> <br />~.- " <br /> <br />waters. Through the use of these existing tools, adequate protection of high <br /> <br />$":-: <br />n:~~j <br /> <br />quality waters from nonpoint source impacts can be achieved. <br /> <br />f::~ -I' <br />f~j <br />~ ';." <br /> <br />~xamples of how these processes have been used to protect high quality waters <br /> <br /> <br />in Colorado include nonpoint source control measures required in the 401 <br /> <br />~!l <br /> <br />certifications of both the proposed Lake Catamount and Adam's Rib Ski Areas. <br /> <br /> <br />The Division has also provided comments on the U.S. Forest Service in regards <br /> <br />:~:'::;- <br /> <br />f.:3 <br />r;:-:; <br /> <br />to the proposed timber activities in the Grand Mesa, Uncompahgre, and Gunnison <br /> <br /> <br />National Forests. <br /> <br />-8- <br />
