<br />salient features of his plan.
<br />
<br />Approval of the contractor's plan shall not relieve
<br />the contractor of responsibility for designing,
<br />constructing, operating. and maintaining a turbidity
<br />control plan in a safe and systematic manner. and
<br />for repairing at his expense any damage to, or
<br />failure of, the turbidity control structures and
<br />equipment caused by floods or storm runoff.
<br />
<br />The contractor's design and construction details of
<br />the turbidity control plan shall be submitted in
<br />triplicate to the Construction Engineer, Post Office
<br />Box 1390, Montrose, Colorado, B1401.
<br />
<br />c. Construction operations.- The contractor shall
<br />comply with applicable Federal and State laws,
<br />orders, and regulations concerning the control and
<br />abatement of water pollution.
<br />
<br />The contractor's construction activities shall be
<br />performed by methods that will prevent entrance.
<br />or accidental spillage, of solid matter, contaminants,
<br />debris. and other objectionable pollutants and
<br />wastes into the river, into flowing or dry
<br />watercourses. or into underground water sources.
<br />Such pollutants and wastes include, but are not
<br />restricted to refuse, garbage, cement, concrete,
<br />sewage effluent. industrial waste. radioactive
<br />substances, mercury, oil and other petroleum
<br />products, aggr~gate, processing tailings, mineral
<br />salts, and thermal pollution, Sanitary wastes shall be
<br />disposed of in accordance with State and local
<br />regulations.
<br />
<br />The contractor's construction program shall give full
<br />consideration to scheduling work during periods of
<br />low flow so that the work may be performed in dry
<br />areas of or adjacent to the riverbed. Earthwork
<br />operations adjacent to, or encroaching on, the river
<br />shall be conducted in a manner to prevent muddy
<br />water and eroded materials from entering the river
<br />by construction of intercepting ditches, barriers,
<br />settling ponds, or by other approved means.
<br />Excavated materials shall not be deposited or stored
<br />in ar alongside af the river or watercourses where
<br />the materials can be washed away by high water ar
<br />storm runoff. When necessary to perform required
<br />construction work in the river channel or in flowing
<br />water, such work shall be scheduled and completed
<br />in the shortest practicable periOd as approved by the
<br />contracting afficer. This required construction work
<br />may include such work as the specified earthwork in
<br />or adjacent to the river channel, pile driving. and
<br />construction, and installation of turbidity control
<br />structures.

<br />d, Turbidity data,- Turbidity readings taken on the
<br />river since April 1971, are available for inspection
<br />by bidders and the contractor at the office of the
<br />Constfuction Engineer, Montrose, Colorado.
<br />
<br />The Government does not guarantee the reliability
<br />or accuracy of any of these data and assumes no
<br />responsibility for any deductions, interpretations, or
<br />conclusions which may be made therefrom.
<br />
<br />e. Payment.-Payment for prevention of water
<br />pollution and control of turbidity will be made at
<br />the lump-sum price bid therefor in the schedule,
<br />Seventy-five percent of the lump-sum price will be
<br />included in the first monthly progress estimate
<br />prepared after completion of all turbidity control
<br />structures, installation of equipment, and
<br />completion of all other appurtenant features
<br />necessary for operating the turbidity control plan.
<br />The remaining 25 percent will be included in the
<br />first monthly progress payment after removal of the
<br />turbidity control structures and cleanup of the
<br />structure sites.
<br />
<br />41. ABATEMENT OF AIR POLLUTION
<br />
<br />The contractor shall comply with applicable Federal,
<br />State, and local laws. and regulations concerning the
<br />prevention and control of air pollution.
<br />
<br />In conduct of construction activities and operation of
<br />equipment, the contractor shall utilize such practicable
<br />methods and devices as are reasonably available to
<br />control, prevent, and otherwise minimize atmospheric
<br />emissions or discharges of air contaminants.
<br />
<br />The emission of dust into the atmosphere will not be
<br />permitted during the manufacture, handling, and
<br />storage of concrete aggregates, and the contractor shall
<br />use such methods and equipment as are necessary for
<br />the collection and disposal, or prevention, of dust
<br />during these operations. The contractor's methods of
<br />storing and handling cement and pozzolans shall also
<br />include means of eliminating atmospheric discharges of
<br />dust,
<br />
<br />Equipment and vehicles that show excessive emissions
<br />of exhaust gases due to poor engine adjustments, or
<br />other inefficient operating conditions, shall not be
<br />operated until corrective repairs or adjustments are
<br />made.
<br />
<br />Burning of materials resulting from clearing of trees
<br />and brush, combustible construction materials, and
<br />rubbish will be permitted only when atmospheric
<br />conditions for burning are considered favorable by
<br />appropriate State or local air pollution or fire
<br />authorities.
