shall be protected from damage that may be caused
by the contractor's construction operations and
equipment, The removal of trees or shrubs will be
permitted only after prior approval by the
contracting officer.

Layout of the contractor's construction plant,
location of access and haul routes, and operations in
borrow and spoil areas shall be approved by the
contracting officer, Both the layout and actual
construction of such facilities shall be planned and
conducted in such manner that all trees not
approved for removal by the contracting officer
shall be preserved and adequately protected from
either direct or indirect damage by the contractor's
operations. The contractor's camp facilities, such as
shops, warehouse, storage areas, and parking areas
shall be located and arranged so that removal of
trees and shrubs will be the minimum practicable as
approved by the contracting officer.

Special care shall be exercised where trees or shrubs
are exposed to injuries by construction equipment,
blasting, excavating. dumping. chemical damage, or
other operations; and the contractor shall
adequately protect such trees by protective barriers
or other methods approved by the contracting
officer.

Except in emergency cases or when otherwise
approved by the contracting officer, trees shall not
be used for anchorages. Where such use is approved,
the trunk shall be wrapped with a sufficient
thickness of burlap or other approved material over
which softwood cleats shall be tied before any rope.

b. Restoration of damage.- The contractor shall be
responsible for injuries to trees caused by his
operations. The term "injury" shall include, without
limitation, bruising, scarring, tearing, and breaking
of roots. trunk, or branches. All injured trees shall
be repaired or restored as nearly as practicable
without delay to their original condition at the
contractor's expense. The contracting officer will
determine the method of repair, treatment, or
restoration to be used for injured trees as
recommended by an experienced horticulturist or
tree surgeon. provided by and at the expense of the
contractor. All repairs, treatment, or restoration of
injured trees shall be performed under the direction
of a I icensed tree surgeon provided by and at the
expense of the contractor. Repairs shall include
shaping of wounds, sealing of wounds or cuts, and
removal of damaged limbs. Scars or wounds shall be
sealed with an approved tree dressing. Where tree

climbing is necessary, the use of climbing spurs will
not be permitted, and climbing ropes will be
required where determined necessary for safety.

Trees that in the opinion of the contracting officer
are beyond saving shall be removed and replaced
early in the next planting season with a tree of the
same species or other approved species, and of the
maximum size that is practicable to plant and
sustain growth in the particular environment. NeYJly
planted trees shall be guyed, watered, and
maintained for a period of 1 year. Any newly
planted tree that dies shall be removed and replaced
as directed, with such replacement trees being
maintained for a period of 1 year from the date of
replacement.

c. Costs.- The costs of all work required by this
paragraph shall be included in the prices bid in the
schedule for other items of work.

40. PREVENTION OF WATER
POLLUTION AND CONTROL
OF TURBIDITY

a. General.- The intent of the following provisions
is to prescribe water quality controls and preventive
measures for control of turbidity and of pollution in
the river due to construction required by these
specifications. Water from diversion and foundation
tunnel construction, including ground-water seepage
from tunnels or other construction activities, shall
not be allowed to enter the river without the use of
suitable turbidity control methods as described in
these specifications.

The lump-sum price bid in the schedule for
prevention of water pollution and control of
turbidity shall include the costs of:

(1) Furnishing and installing turbidity control
plant or system and appurtenances capable of
removing turbidity and alkalinity. The turbidity
control plant or system and appurtenances shall
have a minimum treatment capacity of 200 gpm
for the treatment of water from the tunnels.
Additional capacity may be required to treat
waters seeping through or accumulating behind
the structures protecting the diversion tunnel
portals, from the washing of the commercially
obtained aggregate if such washing is performed
by the contractor at the site, and from the
contractor's operations other than tunnel
construction. Such additional capacity shall be
provided by and at the expense of the
contractor.
