<br />. <br /> <br />, <br />FLORIDA '>lATER CONS"'..RVANC1 DISTRICT <br /> <br />Reallocation aDd Transfer of lla..er Al10t.I:lents <br /> <br />REALLOCATION - rnvOLUNI'ARY <br /> <br />In addition to "he procedures above set out for voluntary reallocatioDS, <br />a procedure is hereoy provided for involuntary reallocations. The purpose <br />and effect thereof are the S8.l~e as in the case, of voluntary reallocations, <br />but toe procedure is initia..ed by the application of less than all of the <br />interested o~ners and lien holders, aDd may be initiated ~hol1y and solely <br />by the District itself. This procedure is deemed necessary by reason of the <br />fac.. tl~t the District recognizes that some interested parties may be dila- <br />tory in, or even refuse toO, join in a voluntary application. <br /> <br />RULES AND REGULATIONS <br /> <br />. <br /> <br />(l) An application for reallocation shall be made on a form therefor <br />furnished by the District. It shall be signed by at least one <br />owner of land of record ~ithin the boundaries of the Original <br />Allot.rnen.. Petition and Order, or, if there has been a previous re- <br />allocation with respect ..0 the lands covered by the Original Peti- <br />tion aDd Order, then by an owner of record within ..hat portion of <br />lands covered by the Original Petition aDd Order for which further <br />reallocation is sought. Toe signatures of all applicants 11IUSt be <br />ac,;nowledged. Appl1cants must be owners of record as of February 1 <br />next preceding the date upon which the District determines to hold <br />its hearing upon the application. <br /> <br />(2) Not less than thirty (30) days prior to the date fixed for hearing <br />on such application, the District shall give notice of the time <br />and place of hearing upon the application for reallocation, and of <br />the general purpose thereof, by publishing a copy of such notice <br />tnree (3) tices in a newspaper of general circulation in the County <br />in which the lands are located, the first publication ..0 be not <br />more than four weeks before the date of hearing and the last publi- <br />cation not less than three days before the date of hearing. This <br />Notice shall include a statement that all of the expense of the re- <br />allocation would be borne by the persons to whom the water was re- <br />allocated and that 11' not paid upon approval of ..he reallocation. <br />would be certified as an additional charge against the water so <br />reallocated. <br /> <br />(3) At the time and place fixed for hearins the Board of Directors of the <br />District shall hear all persons interested. including employees or <br />other representatives of the District, and shall thereupon determine <br />the matter nnd cake such reallocation orders as it deems proper. <br /> <br />. <br /> <br />(4) Upon the entry of any reallocation order, a copy thereof shall forth- <br />with be recorded in the County wherein the lands involved are situated. <br />
