<br />. <br /> <br />FLORIM JolArol CONSERVANCY DISTRICT <br /> <br />Peroanent Changes in the Status of <br />Water Allotment Contrscts <br />Reallocation aod Transfer of <br />Water Allotments <br /> <br />There are several pertinent facts regarding the individual <br />water allotments which should be recognized by the allottees. <br /> <br />First: The original water allotments were r.JS.Cl.e by voluntary <br />petitions of the land o\lners reCluestiDg a certain mur,ber of acre- <br />feet of water and, thereafter, an order of the Board of Directors <br />was entered allottiDg a definite number of acre-foot units of water <br />to the lands described in the ovners' petitions. <br /> <br />. <br /> <br />Second: An :lllotoent of an acre-foot of water means that the <br />allottee is entitled to beneficial use of one-twenty flofe thousand <br />seven hundred fortieths (1/25',740) of the annual supply of project <br />irrigation vater available to the CO~Aervancy District and made <br />available for irrigation by the board. PaYJJJent for such vater shall <br />not be reduced because of a shortage of project irrigation water and <br />no liability shall accrue against the District or the United States <br />or their officers, agents, or employees as a result thereof. <br /> <br />Third: By 1av and contract, the allotment is attached to the <br />described land for assessL~ut purposes. It makes the land subject <br />to an annual assessment o~ charges as provided in the original peti- <br />tion and order for the use of the vater and. becomes a tax lien <br />against the land and collectible aloDg with other taxes. The allot- <br />ment follovs the land vhenever the entire tract is conveyed from one <br />party to another. The allotment is not modified or changed by such <br />transaction. Hovever, the District should be notified of such tral~- <br />action so that the allottee records may be appropriately cl~nged. <br /> <br />Fourth: l-bdifications or chaDge of an allotment occurs vhen <br />prop~rty is divided in ovnership or vhen it is requested tr~t vater <br />be per~~nentlj' moved to other land than that to vhich it is already <br />attached. As provided by the Conservancy District .':;'ct, only the <br />District Board is given the pover to reallocate or transfer the <br />vater supply of the District. Such i:JOdii'ications or changes ':JUst be <br />made by action and order of the Board of Directors and in addition <br />the apprcv::.1 of the United states must also be obtained p\:Tsuant to <br />the provisions of the repaJ'lJJent contract betlieen the United States <br />aod the Florida \later Conservancy District. The Act also E;ives to <br />the Board the po\ler to I:la~~e and eni'orce all reasonable rules a:1d <br />regulations. <br /> <br />. <br /> <br />1 <br />
