<br />C) <br />c: <br />c: <br /> <br />. <br /> <br />. <br /> <br />.~ <br /> <br />Reclamation and GVIC do not wish to use condemnation to acquire <br /> <br />( <br /> <br />'.:.1 <br /> <br />easements. <br /> <br />If a lateral has a majority of the stockholders <br /> <br />who want <br /> <br />to participate <br /> <br />but <br /> <br />cannot <br /> <br />obtain <br /> <br />100 percent <br /> <br />participation on a voluntary basis; Reclamation proposes that: <br /> <br />(1) Lateral incorporate with the intent of participating <br /> <br />in the improvement program. <br /> <br />(2) Lateral corporations initiate condemnation procedures. <br /> <br />When Reclamation completes the lateral improvements of all <br /> <br />the 100 percent participating laterals in the valley, it will <br /> <br />ask the State of Colorado if they wish to have additional <br /> <br />laterals included in the program. <br /> <br />At that time, condemnation <br /> <br />will be considered if the condemnation expenses on the lateral, <br /> <br />along with construction costs, do not caUSE: the total costs <br /> <br />to exceed the current cost effectiveness ceiling. <br /> <br />15 <br />
