<br />00 <br /> <br />c-:. <br /> <br />c: <br /> <br />" <br /> <br />~- <br /> <br />':.:',1 <br /> <br />. <br /> <br />. <br /> <br />(3) Temporary and Permanent Easements <br /> <br />All activities involving easement acquisition will be conducted <br /> <br />by <br /> <br />GVIC. <br /> <br />Reclamation <br /> <br />will <br /> <br />define <br /> <br />construction <br /> <br />easement <br /> <br />requirements. <br /> <br />GVIC will define O&M easement requirements. <br /> <br />GVIC and Reclamation will approve all construction and O&M <br /> <br />easement requirements. <br /> <br />Easements will be held by GVIC. <br /> <br />This <br /> <br />does not mean that GVIC owns the property, but merely has the <br /> <br />right to enter the property for construction and OM&R activities <br /> <br />and to inspect the improved system. <br /> <br />Fences, buildings, and other structures may have encroached <br /> <br />upon the laterals over the years and may have to be moved before <br /> <br />construction can begin. <br /> <br />During field surveys, these situations <br /> <br />will be discussed with affected owners on a case-by-case basis. <br /> <br />Where it becomes uneconomical to move structures and a new <br /> <br />alignment for the lateral cannot be found, the pipe lateral <br /> <br />may be terminated or not installed in these areas. <br /> <br />Reclamation will pay for all damages and relocations as a result <br /> <br />of construction within easement boundaries. <br /> <br />O&M easements <br /> <br />will be permanent and require the landowner to agree to keep <br /> <br />all fences and structures outside of the easement. <br /> <br />If the <br /> <br />landowner constructs permanent structures on the permanent <br /> <br />easement and they must be removed to perform O&M, it will be <br /> <br />at the landowner's expense. <br /> <br />14 <br />
